Card Studio Terms of Service
Last updated: [insert date]
These Terms of Service apply when you use the Card Studio website or place an order with us. Please read them carefully before making a purchase.
By using our website or placing an order, you agree to these terms.
1. About Card Studio
Card Studio provides printed greeting cards, including personalised, photographic and made-to-order designs.
Card Studio is operated by:
Business owner or legal name: [insert name]
Trading name: Card Studio
Business address: [insert business address]
Email: [insert email address]
2. Using Our Website
You may use the Card Studio website for lawful personal shopping purposes.
You must not:
-
Use the website for fraudulent or unlawful purposes.
-
Attempt to interfere with the operation or security of the website.
-
Copy, reproduce or commercially exploit our website, photographs, card designs or written content without permission.
-
Upload unlawful, offensive, abusive, discriminatory or infringing material.
-
Provide false or misleading information when placing an order.
We may restrict or refuse access to the website where we reasonably believe these terms have been breached.
3. Product Information
Card Studio takes reasonable care to ensure that product photographs, descriptions, measurements and prices are accurate.
Screen settings, lighting and printing processes can cause colours to appear slightly different from those displayed online. Small differences in colour or positioning that do not materially affect the design will not normally mean that a product is faulty.
All sizes and measurements are approximate unless otherwise stated.
Product packaging may occasionally differ from photographs shown on the website.
4. Personalised Orders
Customers are responsible for checking all personalised information before submitting an order. This includes:
-
Names
-
Ages
-
Dates
-
Messages
-
Spelling
-
Punctuation
-
Delivery details
-
Uploaded photographs
-
Any other requested personalisation
Card Studio will reproduce the information supplied or approved by the customer. We are not responsible for errors contained in information supplied by the customer.
Where a proof is provided, production will normally begin after the customer approves it. The customer is responsible for checking the complete proof carefully.
Approval of a proof confirms that the wording, spelling, photographs, layout and personalisation are acceptable.
5. Customer Photographs and Uploaded Content
By supplying a photograph, message, logo or other material, you confirm that:
-
You own the material or have permission to use it.
-
Card Studio has permission to use it to create and fulfil your order.
-
Its use will not infringe another person’s copyright, privacy or other rights.
-
The material is not unlawful, threatening, abusive, discriminatory or obscene.
Uploaded material will only be used as reasonably necessary to process and fulfil your order, subject to our Privacy Policy.
Card Studio may refuse or cancel an order containing material that we reasonably believe is unlawful, offensive, harmful or infringes another person’s rights.
6. Placing an Order
After placing an order, you should receive an order acknowledgement. This confirms that we have received your order but does not necessarily mean that it has been accepted.
A contract is formed when Card Studio confirms that your order has been accepted or begins producing or dispatching the order.
We may refuse or cancel an order where:
-
The product is unavailable.
-
Payment cannot be authorised.
-
The price or product information contains an obvious error.
-
We cannot fulfil the requested personalisation.
-
The supplied content breaches these terms.
-
We reasonably suspect fraud or unlawful activity.
Where payment has already been taken for an order that we cannot accept, the amount paid will be refunded.
7. Prices and Payment
All prices are shown in pounds sterling unless otherwise stated.
Delivery charges will be displayed before the order is completed.
The total price payable will be shown at checkout. Payment must be successfully authorised before an order is produced or dispatched.
Card Studio may change product prices at any time, but price changes will not affect orders that have already been accepted.
If an obvious pricing error occurs, we may contact you to provide the correct price or cancel and refund the order.
8. Changing or Cancelling an Order
Please contact Card Studio immediately when requesting a change or cancellation.
A personalised order may only be changed or cancelled before design or production work begins. Once work has started, we may be unable to make changes or provide a refund because the item is being produced specifically for the customer.
Changes requested after production has started may require a new order or an additional payment.
This does not affect your statutory rights where Card Studio has made an error or the item is faulty, damaged or not as described.
9. Delivery
Delivery estimates are provided in good faith but are not guaranteed unless Card Studio expressly agrees to a guaranteed delivery date.
Production time and delivery time are separate. Personalised cards may require additional time to design, approve and produce.
Customers are responsible for supplying a complete and accurate delivery address. Card Studio is not responsible for delays or failed delivery caused by incorrect or incomplete information supplied by the customer.
Please contact us if an order has not arrived within the expected delivery period. We will investigate the delivery and, where appropriate, arrange a replacement or refund.
Card Studio remains responsible for an order until it is delivered to you or to another person you have identified to receive it.
10. Returns and Refunds
Returns, cancellations and refunds are governed by the Card Studio Returns and Refund Policy, which forms part of these Terms of Service.
Personalised, customised and made-to-order products cannot normally be returned or refunded because the customer has changed their mind.
This includes cards containing customer-supplied names, ages, messages, dates, photographs or other personalised details.
Refunds or free replacements will not normally be provided for errors contained in information submitted or approved by the customer.
Where Card Studio has made a production error, supplied the wrong item, or provided an item that is faulty, damaged or not as described, please contact us with your order number and clear photographs of the issue.
Nothing in these terms limits or removes your statutory consumer rights.
11. Intellectual Property
Unless otherwise stated, the Card Studio name, website content, card designs, illustrations, graphics, photographs, logos and written descriptions belong to Card Studio or are used under licence.
Purchasing a card does not transfer ownership of the design or give permission to reproduce, copy, resell, distribute or commercially use it.
Customers may not remove Card Studio branding or present a Card Studio design as their own work.
Personal photographs and other original material supplied by customers remain the property of their respective owners.
12. Promotions and Discount Codes
Promotional codes must be entered at checkout and cannot normally be applied after an order has been completed.
Discount codes:
-
Cannot be exchanged for cash.
-
May have an expiry date.
-
May be limited to selected products.
-
May not be used with other offers unless stated otherwise.
-
May be withdrawn where they have been issued or used incorrectly.
Card Studio may cancel an order where a discount has been obtained through fraud, technical error or misuse.
13. Website Availability and Third-Party Services
We aim to keep the Card Studio website available and operating correctly, but uninterrupted access cannot be guaranteed.
The website may occasionally be unavailable because of maintenance, technical faults or circumstances outside our reasonable control.
Payments, website hosting, delivery and other services may be provided by third parties. Their own terms and privacy practices may also apply.
Links to third-party websites are provided for convenience. Card Studio is not responsible for the content or availability of those websites.
14. Our Responsibility to Customers
Card Studio is responsible for losses that are a foreseeable result of our breach of these terms or failure to use reasonable care and skill.
We are not responsible for losses that were not reasonably foreseeable when the contract was formed.
Products sold through Card Studio are intended for personal and domestic use. We are not responsible for business losses, including loss of profit, revenue, opportunity or business interruption.
Nothing in these terms excludes or limits liability where doing so would be unlawful, including liability for:
-
Death or personal injury caused by negligence.
-
Fraud or fraudulent misrepresentation.
-
Breach of your statutory consumer rights.
-
Any other liability that cannot legally be excluded.
15. Events Outside Our Control
Card Studio will not be responsible for delays or failure caused by circumstances outside our reasonable control, such as postal disruption, severe weather, transport disruption, power failure or failure of essential third-party services.
Where such an event affects your order, we will take reasonable steps to contact you and minimise the delay. Your statutory rights will not be affected.
16. Privacy and Personal Information
Card Studio processes personal information in accordance with its Privacy Policy and applicable data-protection law.
Information may be shared with trusted service providers where necessary to process payments, produce orders, deliver purchases, operate the website or comply with legal requirements.
Please read the Card Studio Privacy Policy for more information.
17. Changes to These Terms
Card Studio may update these Terms of Service to reflect changes in the business, website, products or applicable law.
The terms in force when an order is accepted will normally apply to that order.
The latest version will be displayed on the Card Studio website with its revision date.
18. Severability
If any provision in these terms is found to be unlawful or unenforceable, the remaining provisions will continue to apply.
19. No Waiver
If Card Studio does not immediately enforce a provision of these terms, this does not mean that we have waived the right to enforce it later.
20. Governing Law
These terms are governed by the laws applicable in Northern Ireland.
Customers living elsewhere in the United Kingdom retain any mandatory legal protections available in the part of the United Kingdom where they live.
